What the platform does and does not do, who provides real estate services, and the rules for using it.
About these terms
These terms apply to everyone who uses the Telegram bot @rent_thai_bot, the Telegram mini-app and the website cashback.rent (the platform). The platform is operated by the company named in the Legal notice.
By using the platform you accept these terms and the Privacy policy. Your requests and acceptance through the bot, mini-app or website are electronic transactions valid under the Electronic Transactions Act B.E. 2544. If a translation differs from the English version, the English version prevails, except where Thai law requires otherwise.
What the platform is
The platform lets you search for property in Thailand, see property information, ask questions, describe what you are looking for and send requests about specific properties. Property information comes from owners, developers and real estate service providers (advertisers) and from publicly available listings.
The platform is not a real estate agent or broker. We do not own, rent out or sell any property, we do not represent owners or tenants, we do not contact owners on your behalf, arrange viewings or take part in negotiations, and we are not a party to any lease, sale, booking or service agreement.
Using the platform is free for people looking for property. Advertisers and real estate service providers may pay us for placement, tools and the requests we deliver to them. These fees are fixed or per request and never depend on whether a lease or sale is concluded.
Requests, viewings and real estate services
When you ask about a property or request a viewing, the platform sends your request to the real estate service provider that lists or manages that property.
Viewings, negotiation, contract preparation and other real estate services are provided by that provider, which is a separate company. The provider identifies itself and its terms before it provides a service to you and is responsible for that service. Any commission is agreed between the owner and the provider.
Cashback shown on the platform is an offer made by the real estate service provider that handles your lease, under its own cashback rules. The provider identifies itself and shows you the rules before you accept its services. The platform displays the offer as advertising and is not responsible for paying it.
We never ask you to pay rent, deposits or purchase money to us. Before paying anyone, check the property, the other party's right to rent or sell it, and the contract.
Property information
Advertisers are responsible for the information they provide. Descriptions of public listings are prepared by us from public sources and may be incomplete. Where the platform marks a detail as checked, it shows what was checked and when. Other information is shown as received.
Availability and price can change at any time. A property shown on the platform may already be rented or sold.
Public listings are rewritten into a neutral description. We do not publish the original author's name or contact details. We may check, edit, hide or remove any listing, including listings that look inaccurate, outdated or unlawful.
AI assistant
Some replies in the bot are written by an AI assistant. It answers common questions and passes other questions to our support team or, for property services, to the real estate service provider.
AI replies can be wrong or incomplete. Confirm anything that matters for your decision (price, availability, contract terms) with the owner or the real estate service provider before relying on it. The assistant does not give legal, tax or immigration advice.
Your obligations
Give accurate information in your requests. Be at least 20 years old, or legally of age by marriage, or use the platform with the consent of a parent or guardian. Use the platform only lawfully, to search for or list property.
Do not copy, scrape, resell or systematically download listings, photos or data, and do not interfere with the security or operation of the platform.
You keep your rights in messages, photos and other content you send. You grant us a non-exclusive, royalty-free licence to use that content to operate the platform and deliver your requests.
Advertisers
Advertisers confirm that they have the right to offer the property and to share its photos and details, and that the information is accurate and kept up to date. They allow us to publish, format, translate and show their listings.
Owner and advertiser contact details are used to verify listings and to deliver requests. We do not show them to people searching for property. Advertisers are responsible for claims arising from their listings. Paid services are agreed separately in writing.
Safety
Our only official Telegram account is @rent_thai_bot. We never ask for payments, deposits or passport copies in chat. Report suspicious requests to team@cashback.rent. Telegram is a third party with its own terms and is not responsible for the platform.
Removal requests and complaints
If content on the platform is inaccurate, infringes your rights, or uses your photos or text without permission, write to team@cashback.rent with your contact details, a link or property number, and the basis of your claim. We may notify the person who supplied the content, who may respond.
We act on justified requests within 5 business days, and within 2 business days for fraud or personal data. Other complaints go to the same address and receive a reply within 7 days.
Suspension
We may suspend or end access for breach of these terms, fraud or a legal requirement, and will tell you why unless the law or security prevents it. You may stop using the platform at any time.
Intellectual property
The platform, its design, software, texts written by us and our brand belong to us or our licensors. Content provided by advertisers remains theirs.
Liability
We do our best to keep the platform accurate and available, but we do not guarantee that it is error free or always available.
Except where caused by our own breach of these terms or our negligence, we are not responsible for: the condition, legal status, availability or price of any property; acts or omissions of owners, advertisers, real estate service providers or other users, including the services they provide; decisions made on AI replies without confirmation; interruptions, third party services (including Telegram) or events outside our control; indirect losses or loss of profit.
Nothing in these terms excludes or limits liability for death or personal injury caused by wilful or negligent acts, for fraud or gross negligence, or any other liability that cannot be excluded under Thai law, including the Unfair Contract Terms Act B.E. 2540. Other exclusions apply only to the extent they are fair and reasonable.
Changes
We may change these terms for legal, security or service reasons. We announce material changes in the bot and on the website at least 15 days before they take effect. Changes do not apply to requests already sent. If you do not agree, stop using the platform; continued use after the effective date means acceptance.
Law and disputes
These terms are governed by the laws of Thailand. If you use the platform as a consumer, you may bring a claim in the Thai court where you live, and we will bring any claim against you only in that court. Other disputes are resolved by the courts of Thailand.
If a provision is invalid, the rest remains in force and the invalid one applies to the extent permitted. These terms and the Privacy policy are the whole agreement between you and us about the platform; services of real estate service providers are governed by their own terms. We may transfer these terms to an affiliate or successor operating the platform, with notice.
